Deliverables, turnaround times, and capabilities described on our website are estimates and may vary based on inputs, volume, and platform requirements.
3. Accounts and accuracy
You are responsible for the information you provide, including product URLs, brand assets, and any content you submit. You represent that you have the rights to all materials you provide and that they do not infringe the rights of any third party.
4. Credits and payment
- Services are billed using a prepaid credit system. Credit packages and pricing are shown on our website and may change at any time.
- Credits are applied to the modules and deliverables you request. Credits do not expire.
- All fees are stated in U.S. dollars and are due at the time of purchase unless otherwise agreed in writing.
- You are responsible for any applicable taxes.
5. Acceptable use
You agree not to use the Services to create or distribute content that is unlawful, deceptive, defamatory, infringing, or that violates the policies of advertising platforms (including Meta, TikTok, Google, and others). We may refuse or remove any request that we believe violates these Terms or applicable law.
6. Intellectual property and licensing
Subject to full payment, you receive a license to use the final creative deliverables we produce for you in connection with your business and advertising. We retain ownership of our underlying tools, templates, models, and workflows. You grant us a limited license to use the assets and information you submit solely to produce your deliverables and, unless you opt out in writing, to display anonymized work samples.
7. Third-party platforms
The Services may help you prepare content for third-party advertising platforms. We do not control those platforms and are not responsible for their decisions, including ad approvals, rejections, account actions, or policy changes.
8. No performance guarantee
Examples, case studies, and results shown on our website are illustrative and do not guarantee any specific outcome. Advertising performance depends on many factors outside our control. We make no warranty that the Services will increase sales, ROAS, or any other metric.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, Mashial LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us for the Services giving rise to the claim in the three (3) months preceding the event.

You agree to indemnify and hold harmless Mashial LLC and its members, officers, and contractors from any claims, damages, or expenses arising out of your use of the Services or your breach of these Terms, including claims related to content or assets you provide.
12. Termination
We may suspend or terminate access to the Services at any time for conduct that violates these Terms or applicable law. Provisions that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Georgia.
